Houston Safari Club Foundation (HSCF) Membership Drive Contest. Official Rules and Legal Disclaimer. By entering, participants agree to be bound by these contest rules and the final decisions of Houston Safari Club Foundation (HSCF). NO PURCHASE, PAYMENT OR CONTRIBUTION OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS DRAWING. Sponsor of this contest is Houston Safari Club Foundation located at 14811 St. Mary’s Lane, Suite 265, Houston, TX 77079. Only one winner will be selected. Odds of winning depend upon the number of participants and entries. Only one (1) contest entry per person, per contest unless otherwise stated. You need not be present to win. This contest will run on a monthly basis. This contest begins on the first day of each month at 12:00 a.m. Central Time (“CT”) and ends on the last day of each month at 12:00 p.m. Central Time (“CT”) (the “Drawing Period”). All entries must be received by the last day of each month at 12:00 p.m. Central Time. Entrants may receive entries by joining as a new HSCF member within the specified contest period. This contest may also be entered by sending a handwritten entry form to HSCF Membership Drive, Houston Safari Club Foundation located at 14811 St. Mary’s Lane, Suite 265, Houston, TX 77079. If a winner cannot be contacted or is disqualified for any reason, HSCF reserves the right to determine an alternate winner or not to award a prize, in its sole discretion. Contest void outside of the U.S. and where prohibited by law. Participants and winner must be U.S. residents. Winner must be 18 years of age or older. Employees of HSCF and members of the immediate family (spouses, siblings, parents, children, grandparents, and grandchildren) are not eligible to participate and win. The prize that may be awarded to the eligible winner is not transferable, redeemable for cash or exchangeable for any other prize. Prizes are offered “as is” with no written, express, or implied warranty. HSCF is not responsible for replacing prizes due to damage prior to, during or after shipping/delivery or events beyond the control of HSCF. Anyone using fraudulent means to participate and/or win the contest will be disqualified. HSCF will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and HSCF’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the HSCF, the HSCF reserves the right to terminate this Contest, or make such other decisions regarding the outcome as HSCF deems appropriate. HSCF may substitute prizes, amend the rules, or discontinue the Contest at any time. All decisions will be made by HSCF and are final. Any valuation of the prize(s) stated above is based on available information provided to the HSCF, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying all applicable taxes related to the prize and paying any expenses associated with any prize which are not specifically provided for in the official rules. Each winner must provide HSCF with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from HSCF will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. Contests are subject to all federal, state, and local laws and regulations and shall be governed by Texas law. Contestants agree that the American Arbitration Association shall have jurisdiction over any dispute or litigation arising from or relating to the contests sponsored by HSCF, should any part of these rules not be legally binding. HSCF, its owners, staff, affiliates, and prize donors are not liable or responsible for: claims, damages, losses, injuries, or death including any third-party claims, arising from or relating to, in whole or in part, any contest, including entry and participation in any contest and acceptance, possession, use or misuse of the prizes; any technical or human errors, malfunctions, failures, etc. resulting in participation of contests; donors who do not follow through with delivery of prizes. HSCF will not sell the winner’s personal information. Your address is required so that the contest sponsors may send or deliver your prize, should you win. Acceptance of prize constitutes permission to use winners name, city, state, and winning entry for promotional purposes.

Winner Selection

On the Giveaway Date listed for each corresponding prize, a winner will be selected for each prize by random electronic means in a drawing of all valid entries received. The entrant will be contacted using the email address or telephone provided with the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules). Sponsor’s decisions as to the administration and operation of the Drawing and the selection of potential winners are final and binding in all matters related to the Drawing. Winners will be notified by email or telephone on or about the Giveaway Date listed above for each corresponding prize.

Verification of Potential Winners

Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winners will be notified by email or telephone, after the date of random drawing on the Giveaway Date dates listed above for each corresponding prize. The potential winners may be required to sign and return to Sponsor, within ten (10) days of the date notice is sent, an affidavit of eligibility, and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable. If a potential winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, the potential winner forfeits the prize. In the event that a potential winner of a Drawing prize is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. The potential drawing winners are subject to verification by Sponsor whose decisions are final and binding in all matters related to the drawing.

Entry Conditions and Release

By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor and/or the Drawing judges which are binding and final in all matters relating to this Drawing; (b) release and hold harmless the Sponsor and its respective parents, subsidiaries, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Drawing, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Drawing, acceptance or use or misuse of prize (including any travel or activity related thereto) as well as physical or mental injury whatsoever, including, but not limited to death, that occur when going to or from or any travel related to the hunt, during the hunt, and/or the broadcast, exploitation or use of any entry; and (c) indemnify, defend and hold harmless the Sponsor and the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorney’s fees) arising out of or relating to an entrant’s participation in the Drawing and/or entrant’s acceptance, use or misuse of any prize. Winners acknowledge that the Released Parties are not in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of prize except that the prize shall be subject to manufacturer’s stated warranty.

Publicity

Except where prohibited, participation in the Drawing constitutes winners consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

General Conditions

Sponsor reserves the right to cancel, suspend and/or modify the Drawing, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Drawing, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Drawing or to be acting in violation of these Official Rules or any other Drawing or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Drawing may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

 

Limitations of Liability

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Drawing; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Drawing; (4) technical or human error which may occur in the administration of the Drawing or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Drawing or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Drawing play, provided that if it is not possible to award another entry due to discontinuance of the Drawing, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

Disputes

Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Drawing, or any prizes awarded, other than those concerning the administration of the Drawing or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Drawing, or any prizes awarded, shall be resolved exclusively by Harris County Courts in Houston, Texas. The parties agree that said court shall have exclusive jurisdiction over all disputes and shall apply Texas law without regard to conflict of law principles. All causes of action arising out of or in connection with this Drawing shall be resolved individually without resorting to any form of class action litigation; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Drawing, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses , and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Drawing, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.

Notice of Reporting Requirements

Participants should be aware that Sponsor may be required to report the names and amounts donated if the donations total more than $100.

Drawing Results

For Drawing results send a hand-printed, self-addressed, stamped envelope to Houston Safari Club Foundation located at 14811 St. Mary’s Lane, Suite 265, Houston, TX 77079. Requests for the winner list must be received by the 15th day of the month following the date of contest closure. 

Houston Safari Club Foundation (HSCF) is a non-profit organization, exempt from federal income tax, under section 501(c)(3) of the United States Internal Revenue Code. The charitable deduction for contributions to HSCF is the cash amount of the contribution, less the value of goods and services received, to the extent permitted by law. HSCF EIN 74-2177975.
